Conditions of Sale
All purchases are to be paid in full in U.S. funds on the day of sale or immediately upon receipt of invoice. There is a 14% buyers premium that will be discounted by 4% if payment is made in cash or by cash equivalent. Successful bidders using our Liveauctioneers bidding platform will also be charged an additional 5% buyers premium. All announcements made on the day of the sale take precedence over any printed matter. We reserve the right to delay the release of any purchased lots until payment has cleared through our bank. We encourage bidders to pre-register and provide a deposit prior to the sale if they anticipate being a particularly heavy buyer. In addition, please be advised that any lots may be withdrawn prior to the sale without notice.
We anticipate receiving bids by telephone, by mail, and over the internet as well as on the floor of the auction room. Notwithstanding the exercise of any bids received prior to actual floor bidding, all bids will be recognized at the discretion of the auctioneer. As a result, any tie bids will normally result in the floor bidder being recognized first in order to break such a tie bid. We highly value those bidders that attend our sale in person and encourage all bidders to attend where possible. In all cases, the auctioneer has final discretion as to the order in which all bids are accepted and his/her decisions will be final.
Although this is not an approval sale, successful mail/internet bidders are granted a 10 day return privilege for errors in description and/or justifiable discrepancies in condition with regard to uncertified (non-third party graded) auction lots.
Mitchell Auctions reserves the right to hold any purchases until we are satisfied of the legitimacy and identity of any buyer. Additionally, Mitchell Auctions LLC will not sell any lot for less than half of the published estimate. Consequently, if a bidder is unwilling to bid at least half of the estimate on any given lot, then he/she can be comfortable in knowing that they have no chance of winning that particular lot.
We do not accept payments by WePay. Unless otherwise instructed by the successful bidder, Mitchell Auctions will assume that all U.S. bidders will be making payment by credit card for the full amount of the purchase including shipping, sales tax and any other applicable charges. Consequently, all bidders that desire to pay in some other fashion are encouraged to arrange for such payments prior to the auction. Additionally, be reminded that we do not accept credit or debit card payments from bidders located outside of the U.S.A. unless suitable references have been given to Mitchell Auctions LLC, and prior payment approval has been given by Mitchell Auctions LLC.
Lot Descriptions and Grading
Any items graded by third party grading services (certified lots) are so indicated within the lot descriptions. Other indications of grade are the opinion of Mitchell Auctions LLC. Although we endeavor to be as accurate as possible with regard to grade, such items may be graded higher or lower if submitted to a third party grading service. Feel free to contact our offices prior to the sale for further information and/or a more detailed description of any lot.

New York State Sales Tax
All lots delivered in New York State are subject to applicable sales tax, unless a valid certificate of resale is presented prior to the auction.
Mitchell Auctions will ship lots to successful bidders at their expense unless otherwise indicated within the lot description (i.e. certain large, heavy, and/or fragile lots might require pickup by the successful buyer at our offices). Any lots that Mitchell Auctions is not willing to ship will be so designated in the catalogue. Additionally, all items shipped outside of the U.S.A. will be done so at the bidders risk. Our standard method of shipping within the United States is U.S. Mail Priority/Insured mail, and our shipping charges will reflect our expenses in using this shipping method. Should a bidder request to use a less expensive method of shipping, we will attempt to be accommodating, however such shipments will be sent at the bidder's risk.
